Liability Waiver

This Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement ("Agreement") is entered into by the undersigned parent/legal guardian ("Parent") on behalf of the minor participant identified in the registration form ("Player"), in consideration for the Player's participation in any and all programs, practices, training sessions, clinics, tryouts, games, tournaments, showcases, travel, and related activities organized, sponsored, or supervised by Cleveland Football Academy, including its officers, directors, employees, coaches, contractors, volunteers, and affiliated club staff (collectively, "CFA").

1. Acknowledgment of Risk. Parent acknowledges that youth soccer is a physically demanding contact sport involving inherent and significant risks of injury, including but not limited to sprains, strains, fractures, concussions, head and neck injuries, collisions with other players, equipment, or playing surfaces, heat-related illness, and in rare cases, catastrophic injury or death. These risks exist whether or not the activity is properly supervised and cannot be entirely eliminated regardless of the care taken by CFA to avoid injury to participants.

2. Voluntary Participation. Parent confirms that the Player's participation in CFA programs and activities is entirely voluntary, and Parent has had the opportunity to ask questions regarding the nature of the activities involved.

3. Assumption of Risk. Parent, on behalf of themselves and the Player, voluntarily and knowingly assumes all risks associated with the Player's participation in CFA activities, whether known or unknown, foreseen or unforeseen, including risks arising from the negligence of CFA, its coaches, staff, volunteers, or other participants, to the fullest extent permitted by Ohio law.

4. Release and Waiver of Liability. In consideration for being permitted to participate, Parent, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue CFA, its officers, directors, employees, coaches, contractors, volunteers, sponsors, and the owners and operators of any facility used for CFA activities (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, illness, or injury, including death, that may be sustained by the Player or Parent while participating in, or while present at, any CFA activity, whether such loss, damage, illness, or injury results from the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

5. Medical Treatment Authorization. Parent authorizes CFA staff and designated emergency personnel to administer first aid and to seek and authorize emergency medical treatment for the Player in the event Parent or the listed Emergency Contact cannot be reached promptly. Parent agrees to be financially responsible for any medical costs incurred. This authorization includes, where applicable, decisions made under CFA's concussion protocol, including removal from play pending medical clearance.

6. Travel Acknowledgment. Parent acknowledges that Player participation may include travel to away games, showcases, and tournaments by various means of transportation, including team- or parent-arranged transportation, and that such travel carries its own inherent risks, including motor vehicle accidents and risks associated with unfamiliar facilities and environments. Parent assumes these risks on the same basis as those described in Sections 1 and 3 above.

7. Indemnification. Parent agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorneys' fees, that the Released Parties may incur due to the Player's participation in CFA activities, whether caused by the negligence of the Released Parties or otherwise, to the extent permitted by law.

8. Photographic/Video Consent. Parent acknowledges that media-related consent is addressed separately in the CFA Media Release, which Parent must also review and sign.

9. Code of Conduct. Parent acknowledges that participation is also conditioned on agreement to the CFA Code of Conduct, signed separately.

10. Severability. If any provision of this Agreement is found unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

11. Governing Law. This Agreement shall be governed by the laws of the State of Ohio.

12. Acknowledgment. Parent has read this Agreement in its entirety, understands its terms, understands that they are giving up substantial legal rights on behalf of themselves and the Player, and signs it voluntarily and of their own free will, intending it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
